Without prejudice to Article L. 612-39 of the Monetary and Financial Code, the administrative authorisation provided for in Article L. 382-1 of this Code may be withdrawn by the Autorité de contrôle prudentiel et de résolution in the event of a prolonged absence of activity, a breach of the balance between the financial resources of the supplementary occupational pension fund and its activity or, if the general interest so requires, substantial changes affecting the distribution of its capital, the quality of the shareholders or the composition of the management bodies. It may also be withdrawn by the AMF if the undertakings referred to in Article L. 382-2 are no longer complied with, even though the fund’s situation justifies maintaining them.
The Autorité de contrôle prudentiel et de résolution will withdraw the authorisation granted to a supplementary occupational pension fund if the fund no longer has the solvency margin required to cover the guarantee fund, if it considers that the financing plan presented in accordance with article L. 385-8 is manifestly insufficient or if, within three months of establishing that the guarantee fund is not covered, the supplementary occupational pension fund concerned does not comply with the financing plan approved by the Autorité de contrôle prudentiel et de résolution.
