Article L4133-2 of the French Labour Code

Without prejudice to the right to have recourse, if the conditions are met, to the reporting or public disclosure mechanism provided for in Chapter II of Title I of Law 2016-1691 of 9 December 2016 on transparency, the fight against corruption and the modernisation of economic life, the staff representative on the social and economic committee who becomes aware, in particular through an employee, that the products or manufacturing processes used or implemented by the establishment pose a serious risk to public health or the environment shall immediately alert the employer.

The alert is recorded in writing under conditions determined by regulation.

The employer shall examine the situation jointly with the staff representative on the social and economic committee who forwarded the alert and shall inform him of the action it intends to take.

Article L4133-2

Sans préjudice du droit de recourir, si les conditions en sont remplies, au dispositif de signalement ou de divulgation publique prévu au chapitre II du titre Ier de la loi n° 2016-1691 du 9 décembre 2016 relative à la transparence, à la lutte contre la corruption et à la modernisation de la vie économique, le représentant du personnel au comité social et économique qui constate, notamment par l’intermédiaire d’un travailleur, que les produits ou procédés de fabrication utilisés ou mis en œuvre par l’établissement font peser un risque grave pour la santé publique ou l’environnement en alerte immédiatement l’employeur.

L’alerte est consignée par écrit dans des conditions déterminées par voie réglementaire.

L’employeur examine la situation conjointement avec le représentant du personnel au comité social et économique qui lui a transmis l’alerte et l’informe de la suite qu’il réserve à celle-ci.
