Article L422-10 of the French Insurance Code

The sums recovered by the guarantee fund are used first and foremost to reimburse the guarantee fund for the compensation or provisions paid to the civil party pursuant to article L. 422-7, any enforcement costs incurred and part of the management costs mentioned in article L. 422-9 equal to a percentage of the compensation or provisions paid to the civil party pursuant to article L. 422-7. This percentage is set by order of the Insurance Minister.

For sums recovered by the fund in excess of the compensation, provisions or costs mentioned in the previous paragraph, the fund shall receive, by way of reimbursement of the management costs mentioned in article L. 422-9, an amount equal to the same percentage of these sums. The balance is paid to the civil party.

The total amount of management fees received by the fund may not under any circumstances exceed the amount determined pursuant to article L. 422-9.

Les sommes recouvrées par le fonds de garantie sont utilisées en priorité pour le remboursement au fonds de garantie des indemnités ou des provisions versées à la partie civile en application de l’article L. 422-7, des frais d’exécution éventuellement exposés et d’une partie des frais de gestion mentionnés à l’article L. 422-9 égale à un pourcentage des indemnités ou des provisions versées à la partie civile en application de l’article L. 422-7. Ce pourcentage est fixé par arrêté du ministre chargé des assurances.

Pour les sommes recouvrées par le fonds au-delà des indemnités, provisions ou frais mentionnés au précédent alinéa, le fonds perçoit, au titre du remboursement des frais de gestion mentionnés à l’article L. 422-9, un montant égal à ce même pourcentage de ces sommes. Le solde est versé à la partie civile.

Le montant total des frais de gestion perçus par le fonds ne peut en aucun cas dépasser le montant déterminé en application de l’article L. 422-9.
