Article L431-14 of the French Insurance Code

A construction insurance risk compensation fund has been set up to contribute, within the framework of agreements that may be concluded for this purpose with the insurance companies concerned, to the compensation of claims affecting buildings for which work began before a date set by decree in the Conseil d’Etat, after which the corresponding premiums will no longer be collected.

The fund may enter into agreements with insurance companies to offset the financial impact of changes in construction costs on their ten-year insurance cover.

The fund contributes to the financing of actions to prevent disorders and promote quality in construction.

Management of the fund is entrusted to the Caisse Centrale de Réassurance.

A Conseil d’Etat decree sets out the conditions for the application of this article.

Article L431-14

Il est institué un fonds de compensation des risques de l’assurance de la construction chargé de contribuer, dans le cadre de conventions qui pourront être conclues à cet effet avec les entreprises d’assurance concernées, à l’indemnisation de sinistres affectant des bâtiments dont les chantiers ont été ouverts avant une date fixée par décret en Conseil d’Etat, à partir de laquelle les primes correspondantes ne seront plus perçues.

Le fonds pourra conclure des conventions avec les entreprises d’assurance afin de compenser les incidences financières de l’évolution des coûts de construction sur leurs garanties d’assurance décennale.

Le fonds contribue au financement d’actions de prévention des désordres et de promotion de la qualité dans la construction.

La gestion du fonds est confiée à la caisse centrale de réassurance.

Un décret en Conseil d’Etat fixe les conditions d’application du présent article.
