Article L432-4-1 of the French Insurance Code

The Chairman of the body referred to in the first paragraph of article L. 432-2 delegates all of his powers of operational management of the aforementioned body to the General Manager of this body. The Chief Executive is appointed by the Minister responsible for the economy, after consultation with the Chairman of the aforementioned body, or, if necessary, dismissed.

The Minister for the Economy appoints a representative to the body referred to in the first paragraph of article L. 432-2, who is responsible for ensuring that the State guarantee is implemented and that the body fulfils the responsibilities entrusted to it by the State. This representative is responsible for monitoring the implementation of the agreement provided for in the first paragraph of article L. 432-4. The representative may, at any time, inspect the accounts of the body referred to in the first paragraph of article L. 432-2, as well as any document or information necessary for the performance of its duties. It may make observations and recommendations to the Managing Director, who shall inform it of the action taken on them within fifteen days of receipt.

Article L432-4-1

Le président de l’organisme mentionné au premier alinéa de l’article L. 432-2 délègue l’ensemble de ses prérogatives de gestion opérationnelle de l’organisme précité au directeur général de cet organisme. Celui-ci est nommé, après avis du président de l’organisme précité, ou, le cas échéant, révoqué par le ministre chargé de l’économie.

Le ministre chargé de l’économie désigne, auprès de l’organisme mentionné au premier alinéa de l’article L. 432-2, un représentant chargé de veiller à la mise en œuvre de la garantie de l’Etat ainsi qu’à l’exercice des responsabilités qui sont confiées par l’Etat à cet organisme. Ce représentant est chargé du contrôle de l’exécution de la convention prévue au premier alinéa de l’article L. 432-4. Il peut prendre connaissance, à tout moment, de la comptabilité de l’organisme mentionné au premier alinéa de l’article L. 432-2 ainsi que de tout document ou information nécessaire à l’exécution de sa mission. Il peut adresser des observations et recommandations au directeur général, qui lui fait connaître, dans un délai de quinze jours à compter de leur réception, les suites qui leur ont été données.
