Article L4383-3 of the French Public Health Code

The creation of institutes or schools for the training of the professionals mentioned in Titles I to VII of this book, nursing assistants, nursery auxiliaries, ambulance attendants and health managers is subject to authorisation issued by the President of the Regional Council, after obtaining the opinion of the Director General of the Regional Health Agency.

Institutes or schools authorised by the President of the Regional Council to provide initial paramedical training or continuing training for jobseekers participate in the regional public vocational training service.

The President of the Regional Council shall, after obtaining the opinion of the Director General of the Regional Health Agency, approve the directors of the training institutes or schools mentioned in the first paragraph.

The authorisations and approvals referred to in this article may be withdrawn in the event of failure to comply with the legislative or regulatory provisions governing the organisation of training and in the event of incapacity or serious misconduct on the part of the directors of these institutes or schools.

The conditions under which authorisations and approvals are issued are laid down by regulation.

La création des instituts ou écoles de formation des professionnels mentionnés aux titres Ier à VII du présent livre, des aides-soignants, des auxiliaires de puériculture, des ambulanciers et des cadres de santé fait l’objet d’une autorisation délivrée par le président du conseil régional, après avis du directeur général de l’agence régionale de santé.

Les instituts ou écoles autorisés par le président du conseil régional à dispenser une formation paramédicale initiale ou une formation continue pour les demandeurs d’emplois participent au service public régional de la formation professionnelle.

Le président du conseil régional agrée, après avis du directeur général de l’agence régionale de santé, les directeurs des instituts ou écoles de formation mentionnés au premier alinéa.

Les autorisations et agréments mentionnés au présent article peuvent être retirés en cas de non-respect des dispositions législatives ou réglementaires régissant l’organisation des formations et d’incapacité ou de faute grave des dirigeants de ces instituts ou écoles.

Les conditions dans lesquelles sont délivrés les autorisations et les agréments sont fixées par voie réglementaire.
