Article L4424-36-1 of the French General Code of Local Authorities

The State representative may ask the territorial collectivity of Corsica to amend the master plan for water development and management to bring it into line with the provisions of articles L. 212-1 and L. 212-2 of the Environment Code.

If, within eight months of this request addressed to the President of the Assembly of Corsica, the amendment procedure has not been successful, he submits a draft amendment to the master plan for water development and management to the assemblies and bodies mentioned in the fourth paragraph of I of Article L. 4424-36, which have four months to issue an opinion. The draft adopted by the State representative is approved by the Corsican Assembly. If it is not approved by the Assembly of Corsica within a period of four months, it may be brought into force by decree in the Council of State.

Article L4424-36-1

Le représentant de l’Etat peut demander à la collectivité territoriale de Corse de faire procéder à la modification du schéma directeur d’aménagement et de gestion des eaux pour le rendre conforme aux dispositions des articles L. 212-1 et L. 212-2 du code de l’environnement.

Si, dans un délai de huit mois à compter de cette demande adressée au président de l’Assemblée de Corse, la procédure de modification n’a pas abouti, il soumet un projet de modification du schéma directeur d’aménagement et de gestion des eaux aux assemblées et organismes mentionnés au quatrième alinéa du I de l’article L. 4424-36, qui disposent d’un délai de quatre mois pour rendre un avis. Le projet arrêté par le représentant de l’Etat est approuvé par l’Assemblée de Corse. A défaut d’approbation par l’Assemblée de Corse dans un délai de quatre mois, il peut être mis en vigueur par décret en Conseil d’Etat.
