The Competition Authority may sit either in plenary session, in sections or as a standing committee. The standing committee is made up of the chairman and four vice-chairmen.
The authority’s panels deliberate by a majority of the members present. The authority’s rules of procedure shall determine the quorum criteria applicable to each of these panels.
In the event of a tied vote, the chairman of the panel shall have the casting vote.
The chairman, or a vice-chairman appointed by him, may alone adopt the decisions provided for in III of Article L. 462-5, in Article L. 462-8, as well as those provided for in articles L. 464-2 to L. 464-6 when they relate to facts referred to the Competition Authority by the Minister pursuant to the penultimate paragraph of Article L. 464-9. It may do the same with regard to the decisions provided for in Article L. 430-5, decisions to review the measures referred to in III and IV of Article L. 430-7, decisions required to implement these measures and decisions to review the commitments made pursuant to Article L. 464-2.
