Article L4623-5-3 of the French Labour Code

The transfer of an occupational health physician included in a partial transfer of a prevention and occupational health service by application of article L. 1224-1 may only take place after authorisation by the labour inspector to whom the prevention and occupational health service belongs, after obtaining the opinion of the occupational health inspector. The labour inspector will ensure that the transfer is not related to the performance of the occupational health doctor’s duties and does not constitute a discriminatory measure.

Le transfert d’un médecin du travail compris dans un transfert partiel de service de prévention et de santé au travail par application de l’article L. 1224-1 ne peut intervenir qu’après autorisation de l’inspecteur du travail dont dépend le service de prévention et de santé au travail, après avis du médecin inspecteur du travail. L’inspecteur du travail s’assure que le transfert n’est pas en lien avec l’exercice des missions du médecin du travail et ne constitue pas une mesure discriminatoire.
