Officers are empowered to investigate and record:
1° Infringements of the regulatory provisions adopted pursuant to II of article L. 231-1, articles L. 231-5, L. 231-6, L. 236-1, L. 236-2 and L. 236-4 of the Rural and Maritime Fishing Code, with the exception of those relating to primary production and those relating to slaughterhouses;
2° Infringements and breaches of the provisions of the following regulations and any European regulations amending them or adopted for their application:
-Regulation (EC) No 178/2002 of the European Parliament and of the Council of 28 January 2002, as amended, laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety ;
-Regulation (EC) No 852/2004 of the European Parliament and of the Council of 29 April 2004, as amended, on the hygiene of foodstuffs, with the exception of the provisions applicable to primary production and slaughterhouses;
-Regulation (EC) No 853/2004 of the European Parliament and of the Council of 29 April 2004, as amended, laying down specific hygiene rules for food of animal origin, with the exception of the provisions applicable to primary production and slaughterhouses ;
-Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004, as amended, on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules, with the exception of rules applicable to primary production and slaughterhouses ;
-Regulation (EC) No 183/2005 of the European Parliament and of the Council of 12 January 2005, as amended, laying down requirements for feed hygiene with the exception of the provisions applicable to primary production;
3° Failure to comply with Chapters IIIand IV of Title V of Book II of the Rural and Maritime Fishing Code;
4° Failure to comply with the provisions of II of Article L. 541-15-10 of the Environment Code;
5° Failure to comply with the provisions of Articles 4, 5 and 7 of Regulation (EU) 2019/1020 of the European Parliament and of the Council of 20 June 2019 on market surveillance and product conformity and amending Directive 2004/42/EC and Regulations (EC) No 765/2008 and (EU) No 305/2011.
