Article L511-5 of the French Consumer Code

Officers are empowered to investigate and record infringements or breaches of the following provisions:

1° Sections 1, 2, 5, 10, 11 and 12 of Chapter I of Title II of Book I;

2° Sections 1 and 2 and subsections 1, 2 , 3 and 7 of Section 3 of Chapter II of Title II of Book I;

3° Chapters I, II and III of Title II of Book II;

4° Sections 1, 2, 4, 7, 8 and 9 of Chapter IV of Title II of Book II ;

5° Chapters II and III of Title I of Book III;

6° Sections 1,2,6 and 7 of Chapter IV of Title I of Book III;

7° Chapter V of Title I of Book III;

8° Chapter II of Title II of Book III;

9° Section 1 of Chapter I of Title II of this Book.

To this end, they have the powers defined in Section 1, subsections 1 to 5 of Section 2 and Section 3 of Chapter II of this Title and may implement the measures provided for in Section 1 of Chapter I of Title II.

For the investigation and detection of the misleading commercial practices referred to in Articles L. 121-2 to L. 121-4, they also have the powers provided for in Article L. 512-15 as well as sub-section 6 of section 2 of chapter II of this title.

Article L511-5

Les agents sont habilités à rechercher et à constater les infractions ou les manquements aux dispositions suivantes :

1° Les sections 1, 2, 5, 10, 11 et 12 du chapitre Ier du titre II du livre Ier ;

2° Les sections 1 et 2 et les sous-sections 1, 2 , 3 et 7 de la section 3 du chapitre II du titre II du livre Ier ;

3° Les chapitres Ier, II et III du titre II du livre II ;

4° Les sections 1, 2, 4, 7, 8 et 9 du chapitre IV du titre II du livre II ;

5° Les chapitres II et III du titre Ier du livre III ;

6° Les sections 1,2,6 et 7 du chapitre IV du titre Ier du livre III ;

7° Le chapitre V du titre Ier du livre III ;

8° Le chapitre II du titre II du livre III ;

9° La section 1 du chapitre Ier du titre II du présent livre.

Ils disposent à cet effet des pouvoirs définis à la section 1, aux sous-sections 1 à 5 de la section 2 ainsi qu’à la section 3 du chapitre II du présent titre et peuvent mettre en œuvre les mesures prévues à la section 1 du chapitre Ier du titre II.

Pour la recherche et la constatation des pratiques commerciales trompeuses mentionnées aux articles L. 121-2 à L. 121-4, ils disposent en outre des pouvoirs prévus à l’article L. 512-15 ainsi qu’à la sous-section 6 de la section 2 du chapitre II du présent titre.
