Article L5124-1 of the French Public Health Code

The manufacture, import, export and wholesale distribution of medicinal products, products and articles mentioned in article L. 4211-1, the manufacture, import and distribution of investigational medicinal products, with the exception of gene therapy preparations and xenogenic cell therapy preparations, as well as the operation of proprietary medicinal products or other medicinal products, generators, kits or precursors defined in 8°, 9° and 10° of article L. 5121-1 may only be carried out in pharmaceutical establishments governed by this chapter.

The preparation, storage, distribution and transfer of advanced therapy medicinal products mentioned in 17° of article L. 5121-1 may also be carried out in establishments authorised under article L. 4211-9-1.

Persons engaged in the activity of brokering medicinal products mentioned in article L. 5124-19 are not subject to the provisions of this chapter.

Article L5124-1

La fabrication, l’importation, l’exportation et la distribution en gros de médicaments, produits et objets mentionnés à l’article L. 4211-1, la fabrication, l’importation et la distribution des médicaments expérimentaux, à l’exception des préparations de thérapie génique et des préparations de thérapie cellulaire xénogénique, ainsi que l’exploitation de spécialités pharmaceutiques ou autres médicaments, de générateurs, trousses ou précurseurs définis aux 8°, 9° et 10° de l’article L. 5121-1 ne peuvent être effectuées que dans des établissements pharmaceutiques régis par le présent chapitre.

La préparation, la conservation, la distribution et la cession des médicaments de thérapie innovante mentionnés au 17° de l’article L. 5121-1 peuvent également être réalisées dans des établissements autorisés au titre de l’article L. 4211-9-1.

Les personnes se livrant à une activité de courtage de médicaments mentionnée à l’article L. 5124-19 ne sont pas soumises aux dispositions du présent chapitre.
