A pharmacy duly established in another Member State of the European Community or party to the Agreement on the European Economic Area may carry out, on behalf of a pharmacy holding the licence provided for in Article L. 5125-18, the activity of subcontracting preparations provided for in the second paragraph of Article L. 5125-1 under the conditions defined in the following paragraphs.
If the pharmacy is located in a Member State of the European Community or a State party to the Agreement on the European Economic Area whose conditions for authorising the activity of subcontracting preparations have previously been recognised as equivalent to those provided for in Article L. 5125-1, it must submit a declaration stating that it has been granted authorisation or approval by the competent authorities.
If the pharmacy does not meet the conditions defined in the previous paragraph, the subcontracting of preparations is subject to obtaining an administrative authorisation, which is issued after verification that the conditions under which the subcontracting is carried out are equivalent to those defined in Article L. 5125-1.
