Article L521-1 of the French Insurance Code

I.-The distributors of insurance products shall act honestly, impartially and professionally in the best interests of the policyholder or member.

II.-Without prejudice to the provisions of articles L. 121-1 to L. 121-5 of the French Consumer Code, all information, including advertising communications, sent by the distributor of insurance products to a potential policyholder or member must be clear, accurate and not misleading. Advertising communications must be clearly identifiable as such.

III – Insurance distributors shall not be remunerated or remunerate or evaluate the performance of their personnel in a way that contravenes their obligation to act in the best interests of the policyholder or member. In particular, a distributor of insurance products does not make any arrangements by way of remuneration, sales targets or otherwise which might encourage it or its staff to recommend a particular insurance product to a prospective policyholder or member when that distributor could offer another insurance product which better meets the requirements and needs of the prospective policyholder or member.

Article L521-1

I.-Les distributeurs de produits d’assurance agissent de manière honnête, impartiale et professionnelle et ce, au mieux des intérêts du souscripteur ou de l’adhérent.

II.-Sans préjudice des dispositions des articles L. 121-1 à L. 121-5 du code de la consommation, toutes les informations, y compris les communications publicitaires adressées par le distributeur de produits d’assurance à un souscripteur éventuel ou à un adhérent éventuel doivent être claires, exactes et non trompeuses. Les communications publicitaires doivent être clairement identifiables en tant que telles.

III.-Les distributeurs de produits d’assurance ne sont pas rémunérés ou ne rémunèrent pas ni n’évaluent les performances de leur personnel d’une façon qui contrevienne à leur obligation d’agir au mieux des intérêts du souscripteur ou de l’adhérent. Un distributeur de produits d’assurance ne prend en particulier aucune disposition sous forme de rémunération, d’objectifs de vente ou autre qui pourrait l’encourager ou encourager son personnel à recommander un produit d’assurance particulier à un souscripteur éventuel ou à un adhérent éventuel alors que ce distributeur pourrait proposer un autre produit d’assurance correspondant mieux aux exigences et aux besoins du souscripteur éventuel ou de l’adhérent éventuel.
