Article L5211-17-2 of the French General Code of Local Authorities

One or more communes that are members of a public establishment of inter-communal cooperation with its own tax system may transfer to the latter, in whole or in part, some of their competences whose transfer is not provided for by law or by the decision establishing the establishment, as well as the property, equipment or public services necessary for their exercise.

These transfers take place under the conditions set out in the second to fifth paragraphs and in the last two paragraphs of article L. 5211-17.

The deliberations mentioned in the second paragraph of the same article L. 5211-17 define, according to objective criteria, the competencies transferred in application of the first paragraph of the present article and determine the division of competencies between the municipalities and the public establishment of inter-municipal cooperation with its own tax status. Where appropriate, the deliberations may establish a list of facilities or services corresponding to the transferred competencies.

Une ou plusieurs communes membres d’un établissement public de coopération intercommunale à fiscalité propre peuvent transférer à ce dernier, en tout ou partie, certaines de leurs compétences dont le transfert n’est pas prévu par la loi ou par la décision institutive ainsi que les biens, équipements ou services publics nécessaires à leur exercice.


Ces transferts interviennent dans les conditions prévues aux deuxième à cinquième alinéas et aux deux derniers alinéas de l’article L. 5211-17.


Les délibérations mentionnées au deuxième alinéa du même article L. 5211-17 définissent, selon des critères objectifs, les compétences transférées en application du premier alinéa du présent article et déterminent le partage des compétences entre les communes et l’établissement public de coopération intercommunale à fiscalité propre. Le cas échéant, les délibérations peuvent établir une liste d’équipements ou de services correspondant aux compétences transférées.
