Article L5211-39-2 of the French General Code of Local Authorities

In the event of the attachment of a commune to a public establishment of inter-municipal cooperation with its own tax status under the conditions provided for in article L. 5210-1-2, the creation of such an establishment by sharing under the conditions provided for in article L. 5211-5-1 A, the extension of the perimeter of a public establishment of inter-municipal cooperation under the conditions provided for in articles L. 5211-18 or L. 5211-41-1 or the withdrawal of a municipality under the conditions provided for in articles L. 5211-19, L. 5214-26 or L. 5216-11, the author of the request or initiative draws up a document presenting an estimate of the impact of the operation on the resources and costs as well as on the personnel of the municipalities and public establishments of inter-municipal cooperation concerned, the content of which is specified by decree.

Where applicable, the representative(s) of the State in the department(s) concerned will provide the applicant or initiator with the information required to draw up this document.

This document will be attached to the referral.
This document is attached to the referral to the municipal councils of the municipalities and to the deliberative body of the public inter-municipal cooperation establishment(s) called upon to give an opinion or a decision on the planned operation. It is also attached, where applicable, to the referral to the relevant departmental inter-municipal cooperation commission(s).

Article L5211-39-2

En cas de rattachement d’une commune à un établissement public de coopération intercommunale à fiscalité propre dans les conditions prévues à l’article L. 5210-1-2, de création d’un tel établissement par partage dans les conditions prévues à l’article L. 5211-5-1 A, d’extension du périmètre d’un établissement public de coopération intercommunale dans les conditions prévues aux articles L. 5211-18 ou L. 5211-41-1 ou de retrait d’une commune dans les conditions prévues aux articles L. 5211-19, L. 5214-26 ou L. 5216-11, l’auteur de la demande ou de l’initiative élabore un document présentant une estimation des incidences de l’opération sur les ressources et les charges ainsi que sur le personnel des communes et établissements publics de coopération intercommunale concernés, dont le contenu est précisé par décret.

Le cas échéant, le ou les représentants de l’Etat dans le ou les départements concernés fournissent à l’auteur de la demande ou de l’initiative les informations nécessaires à l’élaboration de ce document.

Celui-ci est joint à la saisine du conseil municipal des communes et de l’organe délibérant du ou des établissements publics de coopération intercommunale appelés à rendre un avis ou une décision sur l’opération projetée. Il est également joint, le cas échéant, à la saisine de la ou des commissions départementales de la coopération intercommunale concernées.
