Article L5211-7 of the French General Code of Local Authorities

I. – The syndicats de communes are administered by a deliberative body composed of delegates elected by the municipal councils of the member communes under the conditions provided for in article L. 2122-7.

By way of derogation from the first paragraph of this I, the municipal council may unanimously decide not to proceed by secret ballot with the appointments of delegates.

I bis. – (Repealed)

II. – The conditions of eligibility, ineligibility and incompatibilities applicable to the delegates of the municipalities are those provided for elections to the municipal council by articles L. 44 to L. 45-1, L. 228 to L. 237-1and L. 239 of the electoral code, as well as those laid down for elections to the community council by article L. 46 of the same code.

Agents employed by a syndicate or one of its member communes may not be appointed by one of the member communes to represent it on the deliberative body of this establishment.

I. – Les syndicats de communes sont administrés par un organe délibérant composé de délégués élus par les conseils municipaux des communes membres dans les conditions prévues à l’article L. 2122-7.

Par dérogation au premier alinéa du présent I, le conseil municipal peut décider, à l’unanimité, de ne pas procéder par scrutin secret aux nominations des délégués.

II. – Les conditions d’éligibilité, les inéligibilités et les incompatibilités applicables aux délégués des communes sont celles prévues pour les élections au conseil municipal par les articles L. 44 à L. 45-1, L. 228 à L. 237-1 et L. 239 du code électoral, ainsi que celles prévues pour les élections au conseil communautaire par l’article L. 46 du même code.

Les agents employés par un syndicat ou une de ses communes membres ne peuvent être désignés par une des communes membres pour la représenter au sein de l’organe délibérant de cet établissement.
