I. – The syndicats de communes are administered by a deliberative body composed of delegates elected by the municipal councils of the member communes under the conditions provided for in article L. 2122-7.
By way of derogation from the first paragraph of this I, the municipal council may unanimously decide not to proceed by secret ballot with the appointments of delegates.
I bis. – (Repealed)
II. – The conditions of eligibility, ineligibility and incompatibilities applicable to the delegates of the municipalities are those provided for elections to the municipal council by articles L. 44 to L. 45-1, L. 228 to L. 237-1and L. 239 of the electoral code, as well as those laid down for elections to the community council by article L. 46 of the same code.
Agents employed by a syndicate or one of its member communes may not be appointed by one of the member communes to represent it on the deliberative body of this establishment.
