Article L5212-21-1 of the French General Code of Local Authorities

Without prejudice to the application of the provisions of article L. 1618-2, syndicates of municipalities may waive the obligation to deposit with the State the amount of the balance of the investment section from the previous financial year, up to the limit of the depreciation allowance for fixed assets operated as part of a public service of an industrial and commercial nature.

Sans préjudice de l’application des dispositions de l’article L. 1618-2, les syndicats de communes peuvent déroger à l’obligation de dépôt auprès de l’Etat pour le montant du solde d’exécution de la section d’investissement de l’exercice précédent, dans la limite de la dotation aux amortissements des immobilisations exploitées dans le cadre d’un service public à caractère industriel et commercial.
