Article L5214-26 of the French General Code of Local Authorities

By way of derogation from article L. 5211-19, a commune may be authorised, by the representative of the State in the department after receiving the opinion of the departmental commission for inter-communal cooperation meeting in the formation provided for in the second paragraph of article L. 5211-45, to withdraw from a community of communes in order to join another public establishment for inter-communal cooperation with its own tax system, whose community council has accepted the request for membership. The opinion of the commission départementale de la coopération intercommunale is deemed to be negative if it has not been given within two months.

This withdrawal takes place under the conditions set out in article L. 5211-25-1. It reduces the perimeter of the mixed syndicates of which the communauté de communes is a member under the conditions set out in the third paragraph of article L. 5211-19.

Article L5214-26

Par dérogation à l’article L. 5211-19, une commune peut être autorisée, par le représentant de l’Etat dans le département après avis de la commission départementale de la coopération intercommunale réunie dans la formation prévue au second alinéa de l’article L. 5211-45, à se retirer d’une communauté de communes pour adhérer à un autre établissement public de coopération intercommunale à fiscalité propre dont le conseil communautaire a accepté la demande d’adhésion. L’avis de la commission départementale de la coopération intercommunale est réputé négatif s’il n’a pas été rendu à l’issue d’un délai de deux mois.

Ce retrait s’effectue dans les conditions fixées par l’article L. 5211-25-1. Il vaut réduction du périmètre des syndicats mixtes dont la communauté de communes est membre dans les conditions fixées au troisième alinéa de l’article L. 5211-19.
