Article L5215-1 of the French General Code of Local Authorities

The urban community is a public establishment for inter-municipal cooperation that brings together several municipalities in a single block and without an enclave that, on the date of its creation, form a group with a population of more than 250,000 and that join together within an area of solidarity to draw up and run a joint urban development and planning project for their territory. Where the urban community includes one or more priority neighbourhoods for urban policy, this joint project includes a section on social and urban cohesion, making it possible to define the guidelines for the urban community in terms of urban policy and strengthening solidarity between its member municipalities. It determines the ways in which the competences of the urban community contribute to the objectives of social and territorial cohesion.

These conditions are not required for urban communities existing on the date of publication of the loi n° 99-586 du 12 juillet 1999 relative au renforcement et à la simplification de la coopération intercommunale.

The creation of an urban community resulting from the merger of an urban community mentioned in the previous paragraph with one or more other public establishments for intercommunal cooperation is not subject to the population threshold set in the first paragraph.

The population threshold set in the first paragraph does not apply when the public establishment of intercommunal cooperation includes a commune that has lost the status of regional capital, when it exercises all the compulsory competences of the urban communities mentioned in Article L. 5215-20 and that its member municipalities deliberate under the majority conditions provided for in the first paragraph of II of article L. 5211-5 before 1 January 2020.

Article L5215-1

La communauté urbaine est un établissement public de coopération intercommunale regroupant plusieurs communes d’un seul tenant et sans enclave qui forment, à la date de sa création, un ensemble de plus de 250 000 habitants et qui s’associent au sein d’un espace de solidarité, pour élaborer et conduire ensemble un projet commun de développement urbain et d’aménagement de leur territoire. Lorsque la communauté urbaine comprend un ou plusieurs quartiers prioritaires de la politique de la ville, ce projet commun intègre un volet relatif à la cohésion sociale et urbaine permettant de définir les orientations de la communauté urbaine en matière de politique de la ville et de renforcement des solidarités entre ses communes membres. Il détermine les modalités selon lesquelles les compétences de la communauté urbaine concourent aux objectifs de cohésion sociale et territoriale.

Ces conditions ne sont pas exigées pour les communautés urbaines existant à la date de publication de la loi n° 99-586 du 12 juillet 1999 relative au renforcement et à la simplification de la coopération intercommunale.

La création d’une communauté urbaine issue de la fusion d’une communauté urbaine mentionnée au précédent alinéa avec un ou plusieurs autres établissements publics de coopération intercommunale n’est pas soumise au seuil démographique fixé au premier alinéa.

Le seuil de population fixé au premier alinéa ne s’applique pas lorsque l’établissement public de coopération intercommunale comprend une commune ayant perdu la qualité de chef-lieu de région, qu’il exerce l’intégralité des compétences obligatoires des communautés urbaines mentionnées à l’article L. 5215-20 et que ses communes membres délibèrent dans les conditions de majorité prévues au premier alinéa du II de l’article L. 5211-5 avant le 1er janvier 2020.
