Article L5215-28 of the French General Code of Local Authorities

Buildings and movable property forming part of the public domain of the municipalities belonging to the conurbation are assigned ipso jure to the urban community, as soon as it is established, insofar as they are necessary for the exercise of the community’s powers.

The definitive transfer of ownership and of the rights and obligations attached to the transferred assets is effected by amicable agreement.

Failing an amicable agreement, a decree in the Conseil d’Etat, issued after the opinion of a commission whose composition is set by order of the Minister of the Interior and which includes, in particular, mayors and departmental councillors, carries out the definitive transfer of ownership no later than one year after the transfer of competencies to the urban community.

The transfers of property, rights and obligations provided for in the previous paragraphs do not give rise to compensation, duties, taxes, contributions provided for in Article 879 of the General Tax Code or fees.

Les immeubles et meubles faisant partie du domaine public des communes appartenant à l’agglomération sont affectés de plein droit à la communauté urbaine, dès son institution, dans la mesure où ils sont nécessaires à l’exercice des compétences de la communauté.

Le transfert définitif de propriété ainsi que des droits et obligations attachés aux biens transférés est opéré par accord amiable.

A défaut d’accord amiable, un décret en Conseil d’Etat, pris après avis d’une commission dont la composition est fixée par arrêté du ministre de l’intérieur et qui comprend notamment des maires et des conseillers départementaux, procède au transfert définitif de propriété au plus tard un an après les transferts de compétences à la communauté urbaine.

Les transferts de biens, droits et obligations prévus aux alinéas précédents ne donnent pas lieu à indemnité, droit, taxe, contribution prévue à l’article 879 du code général des impôts ou honoraires.
