Article L5218-11 of the French General Code of Local Authorities

I. – Notwithstanding article L. 5217-12, the metropolis of Aix-Marseille-Provence benefits, from 1st January of the year following that of its creation, from a global operating allocation equal to the sum of the following two components:

1° An inter-municipality allocation, calculated in the first year of collection of the global operating allocation, on the basis of its population and the highest per capita allocation received the previous year among the pre-existing public establishments for inter-municipal cooperation. In subsequent years, the Aix-Marseille-Provence metropolitan authority’s inter-municipality allocation is calculated according to the procedures defined in article L. 5211-28. The reductions provided for in article L. 5211-28 apply to the Aix-Marseille-Provence metropolitan authority’s inter-municipality allowance;

2° A compensation allowance calculated according to the procedures defined in article L. 5211-28-1.

II. – For the application of 1° of I of this Article, the population to be taken into account is that defined in Article L. 2334-2.

I. – Par dérogation à l’article L. 5217-12, la métropole d’Aix-Marseille-Provence bénéficie, à compter du 1er janvier de l’année suivant celle de sa création, d’une dotation globale de fonctionnement égale à la somme des deux composantes suivantes :

1° Une dotation d’intercommunalité, calculée la première année de perception de la dotation globale de fonctionnement, en fonction de sa population et de la dotation par habitant la plus élevée perçue l’année précédente parmi les établissements publics de coopération intercommunale préexistants. Les années suivantes, la dotation d’intercommunalité de la métropole d’Aix-Marseille-Provence est calculée selon les modalités définies à l’article L. 5211-28. Les minorations prévues à l’article L. 5211-28 s’appliquent à la dotation d’intercommunalité de la métropole d’Aix-Marseille-Provence ;

2° Une dotation de compensation calculée selon les modalités définies à l’article L. 5211-28-1.

II. – Pour l’application du 1° du I du présent article, la population à prendre en compte est celle définie à l’article L. 2334-2.
