Article L522-6 of the French Insurance Code

Where an intermediary or an insurance undertaking has informed the policyholder or subscriber that it will carry out a periodic assessment of the suitability of the recommended investment products, this assessment will include an updated statement on how the insurance-based investment meets the preferences, objectives and other characteristics of the policyholder or subscriber.

Where the policyholder or subscriber does not provide the information referred to in article L. 522-5, the intermediary or the insurance or capitalisation undertaking shall warn the policyholder or subscriber before concluding the contract.

Article L522-6

Lorsqu’un intermédiaire ou une entreprise d’assurance a informé le souscripteur ou l’adhérent qu’il ou elle procéderait à une évaluation périodique de l’adéquation des produits d’investissement recommandés, cette évaluation comporte une déclaration mise à jour sur la manière dont l’investissement fondé sur l’assurance répond aux préférences, aux objectifs et aux autres caractéristiques du souscripteur ou de l’adhérent.

Lorsque le souscripteur ou l’adhérent ne fournit pas les informations mentionnées à l’article L. 522-5, l’intermédiaire ou l’entreprise d’assurance ou de capitalisation le met en garde préalablement à la conclusion du contrat.
