Article L531-6 of the French Consumer Code

Without prejudice to any other penalties incurred, where the non-compliance of a product with the regulations has been established by a test or analysis, carried out following the taking of a sample pursuant to this book, the person responsible for placing the product on the market or, where applicable, any other person responsible for the non-compliance shall bear, as a penalty imposed by the administrative authority, the costs of sampling, transport, analysis or testing incurred by that authority.
The procedures for applying this article, in particular the ceiling for this penalty, shall be laid down by decree in the Conseil d’Etat.

Article L531-6

Sans préjudice des autres sanctions encourues, lorsque la non-conformité à la réglementation d’un produit a été établie par un essai ou une analyse, réalisé à la suite d’un prélèvement d’échantillon effectué en application du présent livre, le responsable de la mise sur le marché du produit ou, le cas échéant, toute autre personne responsable de la non-conformité supporte, à titre de sanction infligée par l’autorité administrative, les frais de prélèvement, de transport, d’analyse ou d’essai que cette autorité a exposés.
Les modalités d’application du présent article, notamment le plafond de cette sanction, sont fixées par décret en Conseil d’Etat.
