Article L5424-4 of the French Public Health Code

The following constitutes a breach subject to financial penalties:

1° Selling the medicinal products and products mentioned in article L. 5121-8 at a price higher than that resulting from price regulations;

2° Selling to the public medicinal products, products or objects mentioned in article L. 4211-1 through commission houses, purchasing groups and establishments owned or managed by persons who do not hold one of the diplomas mentioned in article L. 4221-1;

3° Dispensing medicinal products in a pharmacy without wearing the badge corresponding to his capacity as a pharmacist or as a person legally authorised to assist him, contrary to the provisions of article L. 5125-29;

4° Soliciting orders from the public;

5° Receiving orders for medicinal products and other products or objects mentioned in article L. 4211-1 through the usual intermediary of brokers;

6° Distributing at home medicines and other products or objects mentioned in article L. 4211-1, for which the order has reached them through the usual intermediary of brokers;

7° For any person other than a pharmacist or his representative, delivering an order outside the dispensary in a package that does not comply with the provisions of article L. 5125-25;

8° Dispensing blood-derived medicinal products without recording the data required to monitor them in application of article L. 5121-20, 14°;

9° For one of the pharmacists mentioned in article L. 5125-33, disregarding the rules applicable to electronic commerce in medicinal products set out in Chapter Va of Title II of Book I of Part Five of this Code and the rules of good dispensing practice set out in article L. 5121-5.

Article L5424-4

Constitue un manquement soumis à sanction financière le fait :

1° De vendre les médicaments et produits mentionnés à l’article L. 5121-8 à un prix supérieur à celui qui résulte de la réglementation sur les prix ;

2° De vendre au public des médicaments, produits ou objets mentionnés à l’article L. 4211-1 par l’intermédiaire de maisons de commission, de groupements d’achats et d’établissements possédés ou administrés par des personnes non titulaires de l’un des diplômes mentionnés à l’article L. 4221-1 ;

3° De délivrer des médicaments, dans une officine de pharmacie, sans porter l’insigne correspondant à sa qualité de pharmacien ou de personne légalement habilitée à le seconder, contrairement aux dispositions de l’article L. 5125-29 ;

4° De solliciter des commandes auprès du public ;

5° De recevoir des commandes de médicaments et autres produits ou objets mentionnés à l’article L. 4211-1 par l’entremise habituelle de courtiers ;

6° De distribuer à domicile des médicaments et autres produits ou objets mentionnés à l’article L. 4211-1, dont la commande leur est parvenue par l’entremise habituelle de courtiers ;

7° Pour toute personne autre qu’un pharmacien ou son préposé, de remettre une commande en dehors de l’officine dans un paquet non conforme aux dispositions de l’article L. 5125-25 ;

8° De dispenser des médicaments dérivés du sang sans enregistrer les données permettant d’en assurer le suivi en application du 14° de l’article L. 5121-20 ;

9° Pour l’un des pharmaciens mentionnés à l’article L. 5125-33, de méconnaître les règles applicables au commerce électronique de médicaments prévues au chapitre V bis du titre II du livre Ier de la cinquième partie du présent code et les règles de bonnes pratiques de dispensation mentionnées à l’article L. 5121-5.
