Article L5711-5 of the French General Code of Local Authorities

A commune or a public establishment for inter-communal cooperation may be authorised by the representative of the State in the department to withdraw from a mixed syndicate if, following a change in the regulations, in the situation of this legal entity of public law with regard to these regulations or in the competences of this legal entity, its participation in the mixed syndicate has become irrelevant.

The withdrawal is pronounced by order of the representative of the State in the department within two months of the request by the commune or public establishment.

Une commune ou un établissement public de coopération intercommunale peut être autorisé par le représentant de l’Etat dans le département à se retirer d’un syndicat mixte si, à la suite d’une modification de la réglementation, de la situation de cette personne morale de droit public au regard de cette réglementation ou des compétences de cette personne morale, sa participation au syndicat mixte est devenue sans objet.

Le retrait est prononcé par arrêté du représentant de l’Etat dans le département dans un délai de deux mois à compter de la demande de la commune ou de l’établissement public.
