Article L5842-25 of the French General Code of Local Authorities

I. – The articles L. 5216-1 to L. 5216-2 are applicable in French Polynesia subject to the adaptations provided for in II.

II. – For the application of article L. 5216-1:

1° At the end of the second sentence of the first paragraph, the words: “of the department or the largest commune of the department” are replaced by the words: of French Polynesia;

2° At the end of the third sentence of the first paragraph and in the second paragraph, the words: “of the department” are replaced by the words: “of French Polynesia”;

2° bis The fifth sentence is deleted;

2° ter The last three paragraphs are deleted;

3° A final paragraph is inserted as follows:

“Territorial continuity between the member communes of the same agglomeration community is assessed without taking into account the maritime space between the latter. “

I. – Les articles L. 5216-1 à L. 5216-2 sont applicables en Polynésie française sous réserve des adaptations prévues au II.

II. – Pour l’application de l’article L. 5216-1 :

1° A la fin de la deuxième phrase du premier alinéa, les mots : ” du département ou la commune la plus importante du département ” sont remplacés par les mots : de la Polynésie française ;

2° A la fin de la troisième phrase du premier alinéa et au second alinéa, les mots : ” du département ” sont remplacés par les mots : ” de la Polynésie française ” ;

2° bis La cinquième phrase est supprimée ;

2° ter Les trois derniers alinéas sont supprimés ;

3° Il est inséré un dernier alinéa ainsi rédigé :

” La continuité territoriale entre les communes membres d’une même communauté d’agglomération est appréciée sans tenir compte de l’espace maritime entre ces dernières. “
