Article L6112-5 of the French Public Health Code

Private health establishments other than those mentioned in 3° and 4° of article L. 6112-3 which are authorised to provide care to patients in emergency situations are associated with the public hospital service.

Any patient treated in an emergency situation or as part of ongoing care in these establishments benefits from the guarantees provided for in I of article L. 6112-2 of the present code, including for consecutive care linked to this treatment, and in particular from the fact that they will not be billed for exceeding the tariffs set by the administrative authority and the tariffs for fees provided for in 1° of I of article L. 162-14-1 of the social security code.

The establishment associated with the public hospital service ensures, by any means, that patients treated in an emergency situation or as part of the continuity of care are informed that they will not be billed for fees that exceed the rates set by the administrative authority.

If these obligations are not met, the authorisation referred to in the first paragraph of this article and the resulting association with the public hospital service may be suspended or withdrawn, under the conditions set out in article L. 6122-13 of this code.

A rider to the multiannual contract of objectives and resources specifies the conditions of application of this article and the methods of coordination with the other health establishments in the area.

Article L6112-5

Les établissements de santé privés autres que ceux mentionnés aux 3° et 4° de l’article L. 6112-3 qui sont autorisés à exercer une activité de soins prenant en charge des patients en situation d’urgence sont associés au service public hospitalier.

Tout patient pris en charge en situation d’urgence ou dans le cadre de la permanence des soins dans ces établissements bénéficie, y compris pour les soins consécutifs et liés à cette prise en charge, des garanties prévues au I de l’article L. 6112-2 du présent code, notamment de l’absence de facturation de dépassements des tarifs fixés par l’autorité administrative et des tarifs des honoraires prévus au 1° du I de l’article L. 162-14-1 du code de la sécurité sociale.

L’établissement associé au service public hospitalier s’assure, par tout moyen, que les patients pris en charge en situation d’urgence ou dans le cadre de la permanence des soins sont informés de l’absence de facturation de dépassements des tarifs des honoraires.

Lorsque ces obligations ne sont pas respectées, l’autorisation mentionnée au premier alinéa du présent article et l’association au service public hospitalier qui en découle peuvent être suspendues ou retirées, dans les conditions prévues à l’article L. 6122-13 du présent code.

Un avenant au contrat pluriannuel d’objectifs et de moyens précise les conditions d’application du présent article et les modalités de coordination avec les autres établissements de santé du territoire.
