The Consumer Ombudsman carries out his mission with diligence and competence, in complete independence and impartiality, within the framework of a transparent, efficient and fair procedure.
He draws up an annual report on his activity.
The mediator must satisfy the following conditions:
1° Possess skills in the field of mediation as well as good legal knowledge, particularly in the field of consumer affairs;
2° Be appointed for a minimum of three years;
3° Be remunerated regardless of the outcome of the mediation;
4° Not be in a conflict of interest situation and, if necessary, declare it.
The mediator shall be entered on the list of mediators notified to the European Commission.
The detailed rules for the application of this article shall be laid down by decree in the Conseil d’Etat.
