Article L621-8 of the French Consumer Code

When a case is referred to the court under article L. 621-7, the judge may order, where appropriate under penalty, the removal of an unlawful or unfair term in any contract or type of contract offered or intended for the consumer or in any contract being performed.

The associations and bodies mentioned in article L. 621-7 may also ask the judge to declare that this clause is deemed not to have been written in all identical contracts concluded by the same trader with consumers, and to order him to inform the consumers concerned at his own expense by any appropriate means.

Lorsqu’il est saisi en application de l’article L. 621-7, le juge peut ordonner, le cas échéant sous astreinte, la suppression d’une clause illicite ou abusive dans tout contrat ou type de contrat proposé ou destiné au consommateur ou dans tout contrat en cours d’exécution.

Les associations et les organismes mentionnés à l’article L. 621-7 peuvent également demander au juge de déclarer que cette clause est réputée non écrite dans tous les contrats identiques conclus par le même professionnel avec des consommateurs, et de lui ordonner d’en informer à ses frais les consommateurs concernés par tous moyens appropriés.
