Article L622-2 of the French Intellectual Property Code

The following are eligible for the benefits of this chapter:

a) Creators who are nationals of a State party to the Agreement establishing the World Trade Organisation or who have in such a State either their habitual residence or a real and effective industrial or commercial establishment, as well as their successors in title ;

b) Persons meeting the above conditions of nationality, residence or establishment, who proceed in a Member State or in another State party, for the first time in the world, to the commercial exploitation of a topography not yet protected by this chapter and for which they have obtained from the authorised person an exclusive authorisation for the whole of the European Economic Community or the European Economic Area.

Persons, other than those referred to in the preceding paragraph, are admitted to the benefit of this chapter subject to a finding of reciprocity with the countries of which they are nationals or in which they are established.

Sont admis au bénéfice du présent chapitre :

a) Les créateurs ressortissants d’un Etat partie à l’accord instituant l’Organisation mondiale du commerce ou qui ont dans un tel Etat soit leur résidence habituelle, soit un établissement industriel ou commercial, effectif et sérieux, ainsi que leurs ayants cause ;

b) Les personnes répondant aux conditions précitées de nationalité, résidence ou établissement, qui procèdent dans un Etat membre ou dans un autre Etat partie, pour la première fois au monde, à l’exploitation commerciale d’une topographie non encore protégée par le présent chapitre et pour laquelle elles ont obtenu de la personne habilitée une autorisation exclusive pour l’ensemble de la Communauté économique européenne ou de l’Espace économique européen.

Les personnes, autres que celles visées au paragraphe précédent, sont admises au bénéfice du présent chapitre sous réserve d’une constatation de réciprocité avec les pays dont elles sont ressortissantes ou dans lesquels elles sont établies.
