Article L622-5 of the French Intellectual Property Code

Any third party is prohibited from:

– reproducing the protected topography;

– commercially exploiting or holding, transhipping, using, exporting or importing for that purpose any such reproduction or any semiconductor product incorporating it.

This prohibition does not extend:

– to reproduction for the purposes of evaluation, analysis or teaching;

– to the creation, from such analysis or evaluation, of a distinct topography eligible for protection under this chapter.

The above prohibition is not enforceable against a bona fide acquirer of a semiconductor product. The latter shall, however, be liable for fair compensation if he intends to continue the commercial exploitation of the product thus acquired.

Any violation of the prohibition provided for in the preceding paragraphs shall constitute an infringement engaging the civil liability of its author.

Il est interdit à tout tiers :

– de reproduire la topographie protégée ;

– d’exploiter commercialement ou de détenir, transborder, utiliser, exporter ou importer à cette fin une telle reproduction ou tout produit semi-conducteur l’incorporant.

Cette interdiction ne s’étend pas :

– à la reproduction à des fins d’évaluation, d’analyse ou d’enseignement ;

– à la création, à partir d’une telle analyse ou évaluation, d’une topographie distincte pouvant prétendre à la protection du présent chapitre.

L’interdiction ci-dessus n’est pas opposable à l’acquéreur de bonne foi d’un produit semi-conducteur. Celui-ci est cependant redevable d’une juste indemnité s’il entend poursuivre l’exploitation commerciale du produit ainsi acquis.

Toute violation de l’interdiction prévue aux alinéas précédents constitue une contrefaçon engageant la responsabilité civile de son auteur.
