All employees can use the rights in their personal training account to help finance a training course leading to a qualification, designed to enable them to change jobs or professions as part of a career transition project. The employee will be given an assessment prior to taking part in the training course, in order to identify his professional experience and adapt the duration of the proposed training course. They benefit from specific leave when they follow this training course in whole or in part during their working hours.

For employees holding an employment contract with a temporary employment agency and for intermittent employees in the entertainment industry, a decree issued by the Conseil d’Etat will determine the conditions for opening and paying for professional transition projects.

The professional transition project of an employee affected by the professional risk factors mentioned in 1° of the I of article L. 4161-1 may be financed by the allocation paid by France Compétences to the regional inter-professional joint commissions in application of 3° of the IV of article L. 221-1-5 of the Social Security Code, with a view to enabling the employee to access a job not exposed to the occupational risk factors mentioned in Article L. 4161-1 of this Code, when the employee’s professional transition project is co-financed by his employer, under conditions set by decree.

Tout salarié mobilise les droits inscrits sur son compte personnel de formation afin que celui-ci contribue au financement d’une action de formation certifiante, destinée à lui permettre de changer de métier ou de profession dans le cadre d’un projet de transition professionnelle. Il bénéficie d’un positionnement préalable au suivi de l’action de formation afin d’identifier ses acquis professionnels permettant d’adapter la durée du parcours de formation proposé. Il bénéficie d’un congé spécifique lorsqu’il suit cette action de formation en tout ou partie durant son temps de travail.

Pour les salariés titulaires d’un contrat de travail conclu avec une entreprise de travail temporaire et les salariés intermittents du spectacle, un décret en Conseil d’Etat détermine les conditions d’ouverture et de prise en charge des projets de transition professionnelle.

Le projet de transition professionnelle d’un salarié concerné par les facteurs de risques professionnels mentionnés au 1° du I de l’article L. 4161-1 peut être financé par la dotation versée par France compétences aux commissions paritaires interprofessionnelles régionales en application du 3° du IV de l’article L. 221-1-5 du code de la sécurité sociale, en vue de permettre au salarié d’accéder à un emploi non exposé aux facteurs de risques professionnels mentionnés à l’article L. 4161-1 du présent code, lorsque le projet de transition professionnelle du salarié fait l’objet d’un cofinancement assuré par son employeur, dans des conditions fixées par décret.
