Article L6324-1 of the French Public Health Code

In the premises, places, installations and vehicles to which they have access pursuant to article L. 1421-2, as well as in public places, the medical inspectors of public health and the inspectors of the regional health agencies who have the status of doctor, authorised and sworn in under the conditions laid down by decree of the Conseil d’Etat, are authorised to investigate and record the infringements provided for in article L. 6324-2 and the infringements of the regulations mentioned in article L. 6322-3.

The provisions of articles L. 1421-3, L. 5411-2 and L. 5411-3 are applicable to the exercise of this mission.

The agents mentioned in articles L. 511-3 and L. 511-21 of the Consumer Code are authorised to investigate and record the offences defined in II of article L. 6324-2. To this end, they have the powers provided for in article L. 511-6 of the Consumer Code.

Article L6324-1

Dans les locaux, lieux, installations et véhicules auxquels ils ont accès en application de l’article L. 1421-2, ainsi que dans les lieux publics, les médecins inspecteurs de santé publique et les inspecteurs des agences régionales de santé ayant la qualité de médecin habilités et assermentés dans des conditions fixées par décret en Conseil d’Etat ont qualité pour rechercher et constater les infractions prévues à l’article L. 6324-2 et les infractions aux règlements mentionnés à l’article L. 6322-3.

Les dispositions des articles L. 1421-3, L. 5411-2 et L. 5411-3 sont applicables à l’exercice de cette mission.

Les agents mentionnés aux articles L. 511-3 et L. 511-21 du code de la consommation sont habilités à rechercher et constater les infractions définies au II de l’article L. 6324-2. A cet effet, ils disposent des pouvoirs prévus à l’article L. 511-6 du code de la consommation.
