Article L6362-5 of the French Labour Code

The bodies referred to in article L. 6361-2 are required, with regard to the monitoring agents referred to in article L. 6361-5 :

1° Present the documents and records establishing the origin of the income and funds received as well as the nature and reality of the expenditure incurred in carrying out the activities carried out in the field of vocational training ;

2° To justify the validity of these expenses and their connection with their activities, as well as the compliance of the use of the funds with the legal and regulatory provisions governing these activities.

If these conditions are not met, the organisations are subject to the rejection decision provided for in article L. 6362-10 for the expenditure or use of the funds in question.

Article L6362-5

Les organismes mentionnés à l’article L. 6361-2 sont tenus, à l’égard des agents de contrôle mentionnés à l’article L. 6361-5 :

1° De présenter les documents et pièces établissant l’origine des produits et des fonds reçus ainsi que la nature et la réalité des dépenses exposées pour l’exercice des activités conduites en matière de formation professionnelle ;

2° De justifier le bien-fondé de ces dépenses et leur rattachement à leurs activités ainsi que la conformité de l’utilisation des fonds aux dispositions légales et réglementaires régissant ces activités.

A défaut de remplir ces conditions, les organismes font, pour les dépenses ou les emplois de fonds considérés, l’objet de la décision de rejet prévue à l’article L. 6362-10.
