Article L6431-5 of the French Public Health Code

No person may be a member of the Board of Directors :

1° In more than one capacity ;

2° If he is subject to the incapacity provided for inarticle L. 6 of the Electoral Code;

3° If he is a supplier of goods or services, bound to the agency by contract or an employee of the agency.

However, the incompatibility resulting from the status of salaried employee does not apply to the staff representatives mentioned in 5° to 6° of article L. 6431-2.

Nul ne peut être membre du conseil d’administration :

1° A plus d’un titre ;

2° S’il encourt l’incapacité prévue à l’article L. 6 du code électoral ;

3° S’il est fournisseur de biens ou de services, lié à l’agence par contrat ou agent salarié de l’agence.

Toutefois, l’incompatibilité résultant de la qualité d’agent salarié n’est pas opposable aux représentants des personnels mentionnés au 5° à 6° de l’article L. 6431-2.
