Article L712-4 of the French Intellectual Property Code

Within two months of publication of the application for registration, an opposition may be filed with the Director General of the Institut national de la propriété industrielle against an application for registration in the event of infringement of one of the following earlier rights having effect in France:

1° An earlier trademark pursuant to 1° of I of Article L. 711-3 ;

2° An earlier trade mark with a reputation pursuant to 2° of I of Article L. 711-3;

3° A name or business name, if there is a risk of confusion in the mind of the public;

4° A trade name, sign or domain name, whose scope is not solely local, if there is a risk of confusion in the mind of the public;

5° A registered geographical indication mentioned in Article L. 722-1 or an application for a geographical indication subject to the approval of its specifications and subsequent registration;

6° The name, image or reputation of a local authority or a public establishment for inter-communal cooperation;

7° The name of a public entity, if there is a risk of confusion in the mind of the public.

An opposition may also be filed in the event of infringement of a trademark protected in a State party to the Paris Convention for the Protection of Industrial Property under the conditions set out in III of Article L. 711-3.

Article L712-4

Dans le délai de deux mois suivant la publication de la demande d’enregistrement, une opposition peut être formée auprès du directeur général de l’Institut national de la propriété industrielle à l’encontre d’une demande d’enregistrement en cas d’atteinte à l’un des droits antérieurs suivants ayant effet en France :

1° Une marque antérieure en application du 1° du I de l’article L. 711-3 ;

2° Une marque antérieure jouissant d’une renommée en application du 2° du I de l’article L. 711-3 ;

3° Une dénomination ou une raison sociale, s’il existe un risque de confusion dans l’esprit du public ;

4° Un nom commercial, une enseigne ou un nom de domaine, dont la portée n’est pas seulement locale, s’il existe un risque de confusion dans l’esprit du public ;

5° Une indication géographique enregistrée mentionnée à l’article L. 722-1 ou une demande d’indication géographique sous réserve de l’homologation de son cahier des charges et de son enregistrement ultérieur ;

6° Le nom, l’image ou la renommée d’une collectivité territoriale ou d’un établissement public de coopération intercommunale ;

7° Le nom d’une entité publique, s’il existe un risque de confusion dans l’esprit du public.

Une opposition peut également être formée en cas d’atteinte à une marque protégée dans un Etat partie à la convention de Paris pour la protection de la propriété industrielle dans les conditions prévues au III de l’article L. 711-3.
