Article L732-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

When house arrest has been imposed pursuant to 6°, 7° or 8° of article L. 731-3 or articles L. 731-4 or L. 731-5, the maximum period of six months provided for in article L. 732-4 does not apply.
In the case provided for in 7° of article L. 731-3, maintenance under house arrest beyond five years is subject to a specially reasoned decision stating the particular circumstances justifying this extension with regard, in particular, to the absence of sufficient guarantees of the foreign national’s representation or if his or her presence constitutes a serious threat to public order.

Lorsque l’assignation à résidence a été édictée en application des 6°, 7° ou 8° de l’article L. 731-3 ou des articles L. 731-4 ou L. 731-5, la durée maximale de six mois prévue à l’article L. 732-4 ne s’applique pas.
Dans le cas prévu au 7° de l’article L. 731-3, le maintien sous assignation à résidence au-delà de cinq ans fait l’objet d’une décision spécialement motivée faisant état des circonstances particulières justifiant cette prolongation au regard, notamment, de l’absence de garanties suffisantes de représentation de l’étranger ou si sa présence constitue une menace grave pour l’ordre public.
