Article L752-12 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative judge’s decision to suspend enforcement of the decision imposing an obligation to leave French territory puts an end to the foreign national’s house arrest or administrative detention, except where the French Office for the Protection of Refugees and Stateless Persons has issued a rejection decision and the asylum seeker’s presence in France constitutes a serious threat to public order, public security or State security, as referred to in 5° of article L. 531-27.

Article L752-12

La décision du juge administratif de suspendre l’exécution de la décision portant obligation de quitter le territoire français met fin à l’assignation à résidence ou à la rétention administrative de l’étranger, sauf lorsque l’Office français de protection des réfugiés et apatrides a pris une décision de rejet et que la présence en France du demandeur d’asile constitue une menace grave pour l’ordre public, la sécurité publique ou la sûreté de l’Etat, comme mentionné au 5° de l’article L. 531-27.
