Article L752-2 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority may detain the foreign national referred to in article L. 752-1, provided that detention is necessary to determine the elements on which his asylum application is based, in particular to prevent a risk of evading enforcement of the removal decision assessed according to the same criteria as those provided for in article L. 612-3 or when the protection of national security or public order so requires.

Article L752-2

L’autorité administrative peut placer en rétention l’étranger mentionné à l’article L. 752-1, à condition que le placement soit nécessaire pour déterminer les éléments sur lesquels se fonde sa demande d’asile, notamment pour prévenir un risque de soustraction à l’exécution de la décision d’éloignement apprécié selon les mêmes critères que ceux prévus à l’article L. 612-3 ou lorsque la protection de la sécurité nationale ou de l’ordre public l’exige.
