The file lists the measures of the conventional recovery plan mentioned in Article L. 732-2. These measures are communicated to the Banque de France by the Commission. The registration is kept for the duration of the execution of the conventional plan, without being able to exceed seven years.
The file also records measures taken under articles L. 733-1, L. 733-4 and L. 733-7 which are communicated to the Banque de France by the commission or the registry of the judicial court. The registration is kept for the duration of the execution of these measures, without being able to exceed seven years.
When the measures of the agreed plan mentioned in Article L. 732-2 and those taken in application of Articles L. 733-1, L. 733-4 and L. 733-7 are executed without incident, the information relating to the particulars that led to their declaration are deleted at the end of a period of five years from the signing of the agreed plan, the date of the decision of the commission imposing measures or the date of the judgment ordering measures. When, for the same person, a conventional plan mentioned in article L. 732-2 and measures taken pursuant to articles L. 733-1, L. 733-4 and L. 733-7 are prescribed successively, as part of a review or renewal of the plan or measures, the registration is maintained for the overall period of execution of the plan and measures without being able to exceed seven years.
For persons who have benefited from the personal recovery procedure, the information relating to the corresponding entries is deleted on expiry of a period of five years from the decision of the commission or the closure of the procedure. The same five-year period applies to natural persons who have been the subject of a judicial liquidation pursuant to article L. 670-6 of the French Commercial Code.
