Article L752-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

A foreign national whose right to remain in France has ended in application of b or d of 1° of article L. 542-2 and who is the subject of a decision imposing an obligation to leave French territory may, under the conditions set out in this section, apply to the administrative court to suspend the enforcement of this decision until the expiry of the time limit for appeal to the Cour nationale du droit d’asile or, if the matter is referred to the latter, either until the date on which the court’s decision is read out in open court or, if it is decided by order, until the date on which it is notified.

L’étranger dont le droit au maintien sur le territoire a pris fin en application des b ou d du 1° de l’article L. 542-2 et qui fait l’objet d’une décision portant obligation de quitter le territoire français peut, dans les conditions prévues à la présente section, demander au tribunal administratif la suspension de l’exécution de cette décision jusqu’à l’expiration du délai de recours devant la Cour nationale du droit d’asile ou, si celle-ci est saisie, soit jusqu’à la date de la lecture en audience publique de la décision de la cour, soit, s’il est statué par ordonnance, jusqu’à la date de la notification de celle-ci.
