Article L753-1 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The administrative authority may assign to residence or place in detention a foreigner applying for asylum who is the subject of a deportation decision, a penalty of ban from French territory pursuant to article 131-30 of the penal code or an administrative ban from French territory for the time strictly necessary for the French Office for the Protection of Refugees and Stateless Persons to examine his application for asylum, whether this was submitted prior to or subsequent to notification of the deportation decision to which he is subject.
In the event of a decision rejecting or ruling out the asylum application, house arrest or detention may continue pending the foreign national’s departure.

Article L753-1

L’autorité administrative peut assigner à résidence ou placer en rétention l’étranger demandeur d’asile qui fait l’objet d’une décision d’expulsion, d’une peine d’interdiction du territoire français en application de l’article 131-30 du code pénal ou d’une interdiction administrative du territoire français pour le temps strictement nécessaire à l’examen par l’Office français de protection des réfugiés et apatrides de sa demande d’asile, que celle-ci ait été présentée antérieurement ou postérieurement à la notification de la décision d’éloignement dont il fait l’objet.
En cas de décision de rejet ou d’irrecevabilité de la demande d’asile, l’assignation à résidence ou la rétention peuvent se poursuivre dans l’attente du départ de l’étranger.
