Article L754-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

With the exception of the cases mentioned in b and c of 2° of Article L. 542-2, the removal decision may not be enforced before the French Office for the Protection of Refugees and Stateless Persons has issued its decision or, in the event of a referral to the president of the administrative court, before the latter or the magistrate appointed for this purpose has ruled.

A l’exception des cas mentionnés aux b et c du 2° de l’article L. 542-2, la décision d’éloignement ne peut être mise à exécution avant que l’Office français de protection des réfugiés et apatrides ait rendu sa décision ou, en cas de saisine du président du tribunal administratif, avant que ce dernier ou le magistrat désigné à cette fin ait statué.
