Article L821-7 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The road transport companies mentioned in article L. 821-6 are those operating international routes from a State that is not a party to the convention signed in Schengen on 19 June 1990 in the form of regular lines, occasional services or shuttle services, excluding border traffic.
If such a company has been unable to check the travel document and, where applicable, the visa of passengers using its services, it is exempt from the fine provided for in article L. 821-6, provided that it has provided proof of a check on entry into the territory of one of the States party to the said convention or, in the absence of such a check, provided that it has had it carried out on entry into France by the competent services.

Les entreprises de transport routier mentionnées à l’article L. 821-6 sont celles exploitant des liaisons internationales en provenance d’un Etat qui n’est pas partie à la convention signée à Schengen le 19 juin 1990 sous la forme de lignes régulières, de services occasionnels ou de navette, à l’exclusion des trafics frontaliers.
Si une telle entreprise n’a pu procéder à la vérification du document de voyage et, le cas échéant, du visa des passagers empruntant ses services, elle est exonérée de l’amende prévue à l’article L. 821-6, à condition d’avoir justifié d’un contrôle à l’entrée sur le territoire d’un des États parties à ladite convention ou, à défaut d’un tel contrôle, à condition d’y avoir fait procéder à l’entrée en France par les services compétents.
