Article LO6432-2 of the French General Code of Local Authorities

The territorial council may call into question the responsibility of its president by voting on a no-confidence motion.

The no-confidence motion shall state, on the one hand, the grounds on which it is presented and, on the other hand, the name of the candidate called upon to exercise the function of president of the territorial council in the event of the adoption of the no-confidence motion.

This motion shall only be deliberated on when it is signed by one third of the territorial councillors. The vote cannot take place until at least forty-eight hours after the motion has been tabled. Only votes in favour of the motion are counted, and the motion is not considered adopted until it has received the vote of an absolute majority of the members making up the territorial council.

When the motion of no confidence is adopted, the candidate for the office of president of the territorial council takes office immediately.

The executive council is then renewed.

Le conseil territorial peut mettre en cause la responsabilité de son président par le vote d’une motion de défiance.

La motion de défiance mentionne, d’une part, les motifs pour lesquels elle est présentée et, d’autre part, le nom du candidat appelé à exercer la fonction de président du conseil territorial en cas d’adoption de la motion de défiance.

Il n’est délibéré sur cette motion que lorsqu’elle est signée du tiers des conseillers territoriaux. Le vote ne peut avoir lieu que quarante-huit heures au moins après le dépôt de la motion. Sont seuls recensés les votes favorables à la motion, qui n’est considérée comme adoptée que lorsqu’elle a recueilli le vote de la majorité absolue des membres composant le conseil territorial.

Lorsque la motion de défiance est adoptée, le candidat au mandat de président du conseil territorial entre immédiatement en fonction.

Il est ensuite procédé au renouvellement du conseil exécutif.
