Article LO6432-8 of the French General Code of Local Authorities

On a proposal from the President, the Territorial Council may decide to terminate the duties of a Vice-President; it then elects his or her successor under the conditions laid down in Article LO 6432-7.

The territorial council may, with the agreement of the group of elected representatives to which it belongs, terminate the duties of one of the members of the executive council who is not a vice-president. This member is replaced under the conditions laid down in Article LO 6432-7.

Appeals against deliberations adopted in application of this article are referred to the Conseil d’Etat ruling on contentious matters.

Sur proposition du président, le conseil territorial peut décider de mettre fin aux fonctions d’un vice-président ; il élit ensuite son successeur dans les conditions prévues à l’article LO 6432-7.

Le conseil territorial peut, avec l’accord du groupe d’élus auquel il appartient, mettre fin aux fonctions de l’un des membres du conseil exécutif qui n’ont pas la qualité de vice-président. Ce membre est remplacé dans les conditions prévues à l’article LO 6432-7.

Les recours contre les délibérations adoptées en application du présent article sont portés devant le Conseil d’Etat statuant au contentieux.
