Article R114-1 of the French Insurance Code

In all proceedings relating to the determination and settlement of compensation due, the defendant shall be sued in the courts for the place of domicile of the insured, irrespective of the type of insurance involved, except in the case of immovable or movable property, in which case the defendant shall be sued in the courts for the place where the insured objects are located.

However, in the case of insurance against accidents of any kind, the insured may sue the insurer in the court for the place where the harmful event occurred.

Dans toutes les instances relatives à la fixation et au règlement des indemnités dues, le défendeur est assigné devant le tribunal du domicile de l’assuré, de quelque espèce d’assurance qu’il s’agisse, sauf en matière d’immeubles ou de meubles par nature, auquel cas le défendeur est assigné devant le tribunal de la situation des objets assurés.

Toutefois, s’il s’agit d’assurances contre les accidents de toute nature, l’assuré peut assigner l’assureur devant le tribunal du lieu où s’est produit le fait dommageable.
