Article R1212-5 of the French General Code of Local Authorities

The commission is consulted on:

1° The procedures for assessing the increases and decreases in charges resulting from transfers of powers between the State and local and regional authorities;

2° The draft interministerial order provided for in the first paragraph of article L. 1614-3.A this title, its examination covers in particular:

a) The amount of resources devoted by the State or the competent local authorities to the exercise of the competence transferred, as well as the list and the amount of the corresponding expenditure;

b) The equivalence between the amount of compensation appearing in the draft order mentioned in the third paragraph and the amount of resources devoted by the State or by the competent local authorities to the exercise of the competence transferred.

La commission est consultée sur :

1° Les modalités d’évaluation des accroissements et diminutions de charges résultant des transferts de compétences entre l’Etat et les collectivités territoriales ;

2° Le projet d’arrêté interministériel prévu au premier alinéa de l’article L. 1614-3.A ce titre, son examen porte notamment sur :

a) Le montant des ressources consacrées par l’Etat ou les collectivités compétentes à l’exercice de la compétence transférée, ainsi que la liste et le montant des dépenses correspondantes ;

b) L’équivalence entre le montant de la compensation figurant dans le projet d’arrêté mentionné au troisième alinéa et le montant des ressources consacrées par l’Etat ou par les collectivités compétentes à l’exercice de la compétence transférée.
