Any agreement by which a sports association or a sports company seeks to transfer, in compliance with the provisions of article L. 122-16, its name, trademark or any other distinctive sign or to authorise the use thereof or to grant a licence for its use to another legal entity governed by private law must be filed, prior to its entry into force, with the prefect of the département in which the registered office of the sports association or sports company is located.
The Prefect may, by means of a reasoned order issued after consulting the sports federation concerned or the professional league that it has set up, oppose such a transfer, authorisation or concession.
If the Prefect has not made his opposition known three months after the agreement was submitted, the administrative authority is deemed to have waived its right to oppose the transfer.
